These General Terms and Conditions (“T&C”) govern the contractual relationship between BMF DIGITAL SRL, a limited liability company organized and existing under the laws of Romania, having its registered office in Romania, hereinafter referred to as “LinksPulse”, “we”, “us”, or “the Company”, on the one hand, and the Users of the internet pages and services located on the website https://linkspulse.com/, hereinafter referred to as “Advertisers” or “you” as the case might be.
Please read these General Terms and Conditions in their entirety before using the information, marketplace platform, and commercial services offered on the Site (collectively referred to as the "Services").
I. Definitions
Advertiser — A User who has placed a product order (or intends to do so) on the Platform. The Advertiser can be either a legal entity, duly represented by its authorized legal representative (with or without a valid EU VAT registration), or a natural person who is at least 18 (eighteen) years old and possesses full legal capacity.
Content — An advertisement, text, guest blog article, or other work of copyright created upon the Advertiser’s Order by the Company, its agents, or its subcontractors.
Credits — The internal digital currency unit used on the Platform. One (1) Credit equals one (1) USD. Once converted into credits, deposits are designated solely for platform utilization and cannot be further exchanged back for fiat currency or withdrawn.
Fiat Currency — Government-issued currency that is used to make deposits on the platform, such as the US Dollar (USD), Euro (EUR), or Romanian Leu (RON).
Guest Post — A piece of contextual content written for or placed within someone else's Media. The guest post placement may be permanent or temporary, depending on the specific metrics stated in the marketplace listing.
Homepage Link — A backlink appearing exclusively on the homepage of an indexed website.
Inner Page Link / Niche Edit — A backlink placed within an existing or new contextual article on a subpage or inner page of a website, separate from the homepage.
Listing — A specific offer placed on the Platform concerning a digital placement or Media asset that is made available to Advertisers.
Media — Digital assets such as web pages, blogs, online newspapers, magazines, digital publications, or portals where links or content can be hosted.
Order — A confirmation transaction initiated by an Advertiser accepting a Listing via the interactive functionalities of the Platform.
Price of the Product — The net cost listed next to a particular placement or service package on the Platform.
Privacy Policy — The separate corporate document linked to these T&Cs, describing the principles of personal data processing under EU Regulation 2016/679 (GDPR).
Product — Any link building, content creation, manual outreach, or platform service provided by the Company to the Advertiser.
Publisher — An independent webmaster or owner of advertising space who has authorized the Company to list and monetize their website placements on the Platform interface.
Sitewide Link — A backlink integrated into global structural fields (such as footers or sidebars) that appears across every indexed page of a website.
The Platform / The Site — https://linkspulse.com/, including all associated interfaces, subdomains, software components, and databases managed by the Company. It operates as a managed marketplace where the Company offers link inventory, digital content, and publishing solutions to Advertisers.
User — Any individual or entity that has completed the registration profile workflow and accepted these Terms and Conditions.
Working Days — Any calendar day excluding Saturdays, Sundays, and official public holidays applicable within the territory of Romania. Where these T&Cs refer simply to "days," it shall imply regular calendar days.
Parties — Refers collectively to both the Company (LinksPulse) and the Advertiser. A "Party" refers individually to either the Company or the Advertiser.
II. Acceptance of the Terms and Conditions
- These T&Cs outline the scope of services provided by LinksPulse and regulate all standard and administrative relationships between the Company and its Advertisers.
- Express confirmation and digital acceptance of these General Terms and Conditions represent an absolute prerequisite for establishing a valid account and executing purchases on the Platform.
- By confirming these T&Cs, you expressly consent to the collection and processing of your personal data necessary for contract execution, as detailed under our GDPR Privacy Policy guidelines.
- The most up-to-date version of these terms is located at https://linkspulse.com/dashboard/terms. LinksPulse reserves the unilateral right to update, modify, or rewrite portions of these terms at any time. Continued use of your account following updates implies binding acceptance of the revised text.
- The Company may introduce accessory software expansions, filtering mechanics, custom dashboards, or priority tools. Architectural adjustments, design refreshes, or adding/removing visual variables do not constitute a core amendment to these structural T&Cs.
- The Services are provided on an “as is” and “as available” basis. Advertisers hold no structural rights to demand bespoke code developments, feature integrations, or interface changes.
- When interacting with the Platform, specific technical session elements and tracking cookies are utilized. Comprehensive storage details are governed under our Cookie Policy.
- Contract execution begins immediately upon user registration, initial wallet deposit, or the execution of an individual marketplace cart checkout.
- The user profile agreement is established for an indefinite timeframe until explicitly terminated by either Party or closed due to account inactivity or violations.
III. Services Provided by the Company
- The Platform functions as a centralized environment where Advertisers can safely buy link placements, content distribution rights, and native contextual marketing packages on Media networks managed by the Company or its independent Publisher networks.
- The main services provided by the Company include, but are not limited to:
- Provision and maintenance of self-service user dashboards and account controls;
- Real-time system communication portals and notifications;
- Searchable inventory grids displaying Domain metrics, language variables, and pricing data;
- Order input modules for anchor tracking, target URL sorting, and content formatting;
- Billing management systems, transparent credit ledgers, and automated invoicing loops;
- Supervision of publishing deadlines, placement verification tools, and replacement warranty tracking;
- Internal automated support widgets and internal help desks.
- The Company reserves the right to modify service lines, re-tier account thresholds, or introduce reasonable administrative fees for separate diagnostic tools. Past purchase parameters are fully locked and protected from subsequent adjustments.
IV. Rights and Obligations of the Parties
- The Company aggregates and renders structural data points (such as Language, third-party SEO metrics, price points, and processing estimates) across its listed Media lines to guide the Advertiser's choices.
- LinksPulse maintains commercial agreements allowing it to sell and manage the advertising spaces listed on the Platform. The Company warrants that it possesses the necessary permissions to fulfill placements.
- The Company employs clear technical evaluation checkpoints to confirm that connected Media options retain general indexing viability, appearance consistency, and functional layout standards.
- If an Advertiser requires an item to be pulled or un-published prior to the expiration of a designated placement run, the Company will apply professional efforts to coordinate with the underlying webmaster to remove the content within 10 working days. The Company holds no direct structural liability if a third-party host introduces processing delays.
- The Company declares that the inventory placement systems do not intentionally violate known domestic intellectual property parameters, and that data profiles are managed with professional diligence.
- The Company retains absolute discretion to refuse any content submission or target URL order if the text, anchor structure, landing page niche, or overall messaging conflicts with domestic legal framework bounds, contains malicious scripts, or breaches localized standards.
- Strict Anti-Circumvention Rule: The Advertiser is strictly prohibited from bypassing the Platform to contact, negotiate with, or directly pay any Publisher or media partner whose assets were discovered through the LinksPulse database. Any attempt to circumvent the Platform will result in immediate account termination, forfeiture of remaining wallet Credits as a contractual penalty, and potential legal action for breach of commercial confidentiality.
- When utilizing LinksPulse, the Advertiser is obligated to:
- Refrain from actions that stress, scratch, scrape, or intentionally degrade platform server operations;
- Abstain from running unauthorized bots, automated scanning scripts, or extraction extensions across our inventory database;
- Refrain from targeting links toward completely illegal portals, spam loops, or sites running active malware;
- Refrain from using black-hat automation to push synthetic comment traffic or malicious click-bots to live placements.
- The User warrants that any text, graphical content, brand names, or destination URLs provided for campaign execution do not violate third-party trademarks, copyrights, or consumer protection guidelines, and that they possess full legal rights to distribute said materials.
- Each Party remains fully responsible for localized tax compliances, regulatory filings, and legal liabilities stemming from the content distributions they explicitly author or instruct to be placed online.
V. Listings and Order Execution
V.1. Order Placement
- Orders are finalized via the checkouts built into the dashboard portal.
- Placements are locked by moving inventory rows into the active cart workspace.
- Before executing an order, the Advertiser must check all anchor text variables, capitalization paths, and landing URL targets. Confirming an order formally authorizes the immediate deduction of corresponding internal platform Credits.
- Campaign execution runs entirely via pre-funded account allocations.
V.2. Execution Rules
- Users can choose between Guest Posts, Niche Edits, Sitewide options, or Homepage configurations depending on live platform inventory availability.
- The Company may group specific placements into combined discount or thematic bundles.
- The exact processing deadlines (Turnaround Time - TAT) are listed on individual item rows. The standard fulfillment scope spans 7 to 14 business days from target asset validation.
- Once a link placement is successfully deployed on a target domain, the Company updates the status tracker on the Platform and populates the live, viewable destination URL.
- Verification Period: The Advertiser has exactly 3 calendar days from the date a link is marked live to verify its contextual correctness and placement accuracy. If no correction request or valid dispute is submitted via the support portal within this 3-day window, the placement is deemed correct, fully finalized, and complete.
- LinksPulse does not verify the structural legality of external target destination links provided by buyers and remains entirely insulated from downstream algorithmic search console adjustments.
VI. Platform Credits Policy
- Purchases across the secure LinksPulse interface run exclusively on a prepaid system utilizing Credits.
- One (1) Credit is set at a static value of $1 USD (one US Dollar).
- Non-Refundability and Expiration: All fiat currency deposits converted into internal platform Credits are designated solely for campaign transactions on LinksPulse. Credits are non-refundable and cannot be withdrawn or converted back into fiat currency.
- Credits must be active and utilized within 12 months from their initial deposit execution date. Unused or stagnant credits remaining past this 12-month window will expire automatically and be forfeited.
- Credits are securely bound to the verified profile that initiated the deposit. They cannot be transferred, split, or assigned to other users or external dashboard managers.
VII. Financial Terms and Billing
- Checkout functions require a pre-funded credit total equal to or greater than the absolute checkout sum.
- Platform deposits are managed via:
- Direct Bank/SEPA wire transfers to our Romanian corporate accounts;
- Secure Credit/Debit Card processing gateways;
- Verified digital merchant payment processors integrated into the portal.
- Financial deposits must originate from accounts or cards matching the verified business name or identity on the user profile.
- All base marketplace display costs are listed as net figures, excluding Value Added Tax (VAT). VAT will be added at checkout where applicable under current Romanian and European Union tax directives.
- Electronic invoices are dynamically generated by our financial module immediately upon deposit completion and made available for direct download within your billing profile.
- Direct off-platform payment attempts to external webmaster links are strictly forbidden and bypass contract protections.
VIII. Refunds and Warranties
- Cash or fiat currency refunds are not provided once an order moves to "In Progress" or "Completed" status. If a specific media placement fails validation or becomes unavailable due to inventory shifts, the corresponding sum is returned to the user's platform balance as Credits.
- 365-Day Replacement Warranty: LinksPulse provides a full 365-day replacement protection plan. If an ordered backlink drops, turns no-follow, or the hosting page loses indexation within 365 days of completion, the Company will replace it free of charge on an equivalent or higher-metric site. Warranty claims must be logged using our internal support ticket system or via support@linkspulse.com.
IX. Intellectual Property
- Completing a link placement purchase does not grant the Advertiser ownership rights over the underlying target media domains, portals, or hosting source code.
- The Advertiser grants LinksPulse and its deployment partners a non-exclusive, royalty-free, global license to process, format, and host the provided text, anchor phrases, and logos solely for the purpose of completing the active campaign.
- The Company retains all intellectual property rights, trademarks, application code bases, design elements, and automation layouts running behind the LinksPulse.com ecosystem.
X. Confidentiality
- Both Parties agree to maintain strict confidentiality regarding all non-public platform operational metrics, private negotiation files, custom pricing structures, support messages, and specific domain inventories visible within the dashboard.
- This confidentiality clause remains in active force during your account lifecycle and shall persist for a period of 5 years following any account closure.
XI. Indemnification and Liability Limits
- SEO Results Disclaimer: The Company provides professional link placement and distribution solutions, but does not guarantee specific search engine optimization metrics, traffic increases, conversions, revenue gains, or keyword ranking positions. Search engine algorithms rely on hundreds of external variables outside the Company's control.
- The Company assumes zero liability for content choices or site operations running on external third-party media domains that are not owned or controlled by BMF DIGITAL SRL.
- Cap on Liability: To the maximum extent permitted by applicable Romanian law, the total cumulative liability of the Company (BMF DIGITAL SRL) for any claim, breach, error, or damages related to a transaction or service shall be strictly capped at the actual net fiat amount paid by the Advertiser for the specific individual Order giving rise to the dispute.
XII. Termination of Account
- Users may close their dashboard profile at any time by sending a termination confirmation note to our team via email.
- The Company retains absolute discretion to suspend, restrict, or completely delete accounts that violate security rules, scrape data, attempt payment chargebacks, or engage in off-platform circumvention.
XIII. Complaint Handling and Governing Law
- Any complaints regarding link delivery, quality parameters, or invoice records must be sent directly to support@linkspulse.com or opened via the live dashboard Support Desk.
- All complaints will be professionally evaluated, verified, and answered within 14 working days from initial receipt.
- Governing Law: These General Terms and Conditions, your relationship with the platform, and all resulting placement contracts are governed exclusively by, and shall be construed in accordance with, the laws of Romania.
- Jurisdiction and Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms, including its formation, validity, binding effect, interpretation, performance, breach, or termination, shall be referred to and finally resolved by the competent courts of law in Cluj-Napoca, Romania.
